These Terms of Service (“Terms”) govern your use of vinagallica.com (“Vina Gallica”, “the Platform”) and any services offered through it. The Platform is operated by Bogusław Siemiątkowski “Spiżarnia REGIO”, with its registered address at Napoleońska 49, 06-500 Mława, Poland, VAT-EU: PL5691729538.
By creating an account on Vina Gallica, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility
1.1 Who may use Vina Gallica
At this stage, Vina Gallica is open exclusively to businesses registered in France that hold a valid French SIREN number. By registering, you confirm that your business:
- is incorporated or registered in France;
- holds a valid, active SIREN number;
- operates in the French wine sector (winery, wine shop, wine-related hospitality, wine festival, or similar); and
- is represented by an individual who has the authority to enter into binding agreements on behalf of that business.
1.2 Future expansion
Vina Gallica may expand eligibility to businesses in other countries in the future. These Terms will be updated accordingly before any such expansion takes place.
1.3 No consumer access
Vina Gallica does not offer services to individual consumers. All registered users are businesses acting in a commercial capacity.
Summary: Only French wine businesses with a valid SIREN number can register. This is a business-to-business platform, not a consumer service.
2. Nature of the Agreement
2.1 Business-to-business relationship
These Terms constitute a business-to-business (B2B) agreement between Spiżarnia REGIO and the registered business entity (“you”, “the Customer”, “the User”). Consumer protection laws and regulations that apply only to private individuals — including statutory rights of withdrawal under EU consumer law — do not apply to this agreement.
Summary: Because you are a business signing up — not a private individual — consumer protection rules don’t apply here. Any extra protections we offer you are voluntary, not legally mandated.
3. The Platform — What Vina Gallica Provides
3.1 Description
Vina Gallica is an online directory and interactive map of French wine businesses. It allows businesses to create listings that are visible to the public, helping wine enthusiasts and professionals discover French wine producers, retailers, and events.
3.2 No guaranteed outcomes
Vina Gallica is a visibility tool. We do not guarantee any specific number of page views, clicks, leads, customer enquiries, reservations, or commercial results of any kind. The effectiveness of a listing depends on many factors outside our control, including search engine behaviour, user preferences, and market conditions.
3.3 Platform availability
We aim to keep the Platform available at all times but do not provide any uptime guarantee. Scheduled maintenance, technical failures, or third-party service disruptions (including Cloudflare’s infrastructure) may cause temporary unavailability. We will make reasonable efforts to restore access as quickly as possible.
Summary: Vina Gallica lists your business so people can find it. We can’t promise you’ll get any specific number of visitors or customers — that depends on many things beyond our control.
4. Account Registration
4.1 Creating an account
To list your business on Vina Gallica, you must create an account. During registration, you must provide your French SIREN number, which is verified in real time against official French business registry data.
Upon successful validation of an active SIREN number, the Company Name and Company Address fields will be pre-filled automatically — both remain editable before you submit.
Account creation is only permitted once the SIREN number is confirmed as active.
During registration you also need to provide a valid business email address and accurate contact details for your business.
The registration form is protected by Cloudflare Turnstile to prevent automated submissions and ensure the security of the registration process.
4.2 Accuracy of information
You are responsible for ensuring that all information you provide during registration and throughout your use of the Platform is accurate, complete, and kept up to date. Providing false or misleading registration information is grounds for account termination.
4.3 Account security
You are responsible for maintaining the confidentiality of your account login credentials. You must notify us immediately at privacy@vinagallica.com if you suspect unauthorised access to your account.
4.4 One account per business
Each business entity should maintain a single account. Multiple listings (locations, brands, or events) may be added under the same account. Creating multiple accounts for the same legal entity is not permitted.
Summary: Register once, keep your information accurate, and protect your login. You can add multiple listings (e.g. multiple locations) under one account.
5. Listing Plans and Pricing
5.1 Free Plan
The Free Plan is available permanently at no cost and with no time limit. A Free listing includes:
- inclusion in the Vina Gallica directory;
- a pin on the interactive map; and
- a basic information panel (business name, category, location, operating hours or dates for festivals, contact link).
There is no obligation to upgrade to a paid plan at any point.
5.2 Premium Plan
The Premium Plan is available for €50 per year, excluding VAT, billed annually. It includes everything in the Free Plan, plus:
- a full profile page accessible from the directory card (“read more”);
- an image gallery;
- a marketing description authored by your team;
- certifications and awards display;
- videos;
- detailed location information, including directions and nearby attractions.
5.3 Multiple listings
A single account may hold any number of listings, each independently designated as Free or Premium.
5.4 When the Premium period starts
To access the Premium Plan, you must complete the Premium upgrade process from your account dashboard. This involves the following steps:
- Navigate to the Upgrade tab in your dashboard.
- Select your registration path based on your tax status and enter either your EU intra-community VAT number or your SIREN number. Both are validated in real time.
- Once validation is successful, a pre-filled order form appears. Complete the remaining fields and review the details.
- Tick the checkbox confirming your consent to receive invoices electronically by email.
- Submit the form. We will then send a pro-forma invoice to the email address indicated in the form, showing the exact amount due, inclusive of VAT where applicable.
Upon receipt of your completed form, we will grant you provisional Premium access for 33 days, pending receipt of payment. You will simultaneously receive the pro-forma invoice by email, payable by SEPA bank transfer within 30 days.
Your annual Premium subscription period begins on the date we record your payment against the pro-forma invoice. We will notify you by email and add a corresponding note to your account dashboard, showing both the start and end dates of your subscription.
5.5 No automatic renewal
The Premium Plan does not renew automatically. You will receive renewal reminders by email at the following intervals before your Premium period expires:
- 1 month before expiry;
- 1 week before expiry; and
- 3 days before expiry.
A pro-forma invoice will be included with these reminders. This pro-forma invoice is non-binding and does not constitute an automatic contract renewal or a demand for payment. It is provided for your convenience only.
5.6 Grace period and reversion to Free
After your Premium period expires, your listings will remain at Premium level for a 7-day grace period. If you have not renewed by the end of this grace period, all your listings will revert permanently to the Free Plan. You may upgrade back to Premium at any time from your account dashboard.
Summary: The Free Plan is yours forever at no cost. Premium costs €50/year and adds a full profile page, images, and more. It doesn’t renew automatically, but you’ll get reminders. If you don’t renew within the 7-day grace period, your listings drop back to the free level.
6. Payment and VAT
6.1 Payment method
Payments for the Premium Plan are processed in Euro (EUR) only. Payment is made by SEPA bank transfer. After you complete the Premium order form, we will send you a pro-forma invoice by email showing the exact amount due, including VAT where applicable. The pro-forma invoice is payable within 30 days.
Upon receipt of your order form, we may grant you provisional Premium access for 33 days while awaiting payment. We aim to record and confirm your payment within 2 business days of receiving the transfer.
Please note that a pro-forma invoice is not a VAT invoice and cannot be used for tax deduction purposes.
6.2 VAT and EU reverse charge
Vina Gallica is operated by a Polish entity (Spiżarnia REGIO, VAT-EU: PL5691729538).
- If your business holds a valid EU intra-community VAT number, you will be invoiced without VAT under the reverse charge mechanism, and you are responsible for self-assessing and reporting VAT in your own country.
- If your business does not hold an EU VAT number, VAT will be applied to your invoice in accordance with applicable tax regulations. The applicable amount will be shown on the pro-forma invoice before payment is due.

6.3 Invoicing
The Premium order process may involve both a pro-forma invoice and a final VAT invoice. The pro-forma invoice is issued before payment and is for payment purposes only. Following confirmation of payment, we will issue and send the final VAT invoice by email.
7. Listing Submission and Moderation
7.1 How to submit a listing
Listings are submitted through the submit page on the Platform or through your account dashboard. You must complete all required fields in the submission form accurately and in full.
7.2 Review process
Free listings are subject to a standard review before publication. This review covers technical completeness, category relevance, and compliance with the Platform’s content standards.
Listings submitted under a Premium account are not subject to the standard review queue and are published without delay.
7.3 Review timeframe
For Free listings, reviews are typically completed within 3 business days of submission. During high-demand periods, this may take slightly longer.
7.4 Notification of outcome
You will receive an email notification when your listing is approved and published. If your listing is rejected, we will inform you of the reason and, where possible, invite you to correct and resubmit.
7.5 Vina Gallica’s editorial discretion
Vina Gallica reserves the right to reject, remove, or suspend any listing at any time if it does not comply with these Terms or the Platform’s editorial standards, or if circumstances arise that make the listing no longer appropriate for the Platform. Where possible, we will give you an opportunity to remedy the issue before removing a published listing.
Summary: Submit your listing through the website. Free listings go through a standard review before publication, while listings submitted under a Premium account are published without delay.
8. Listing Standards
8.1 Required accuracy
All information in your listing must be accurate, complete, and reflect the current state of your business. This includes your business name, address, contact details, opening hours, business category, and any certifications or awards displayed.
8.2 Category relevance
Your listing must be placed in the correct category (winery, wine shop, wine-related hospitality and experience, wine festival, or such other categories as Vina Gallica may introduce). Listings placed in an incorrect or misleading category will be rejected or recategorised at our discretion.
8.3 Images
Images submitted with your listing must meet the following standards:
- They must be owned by you or licensed to you for commercial use. You may not pass stock photographs off as your own property.
- They must accurately represent the specific business being listed — not a generic location or unrelated property.
- They must be of sufficient resolution and quality for display on the Platform (minimum dimensions will be indicated in the submission form).
- They must not contain watermarks from third-party stock photo services.
- They must not contain offensive, discriminatory, or otherwise inappropriate content.
8.4 Prohibited content
The following content is not permitted in any listing:
- false or misleading information about the business, its products, or its credentials;
- claims of certifications or awards that the business does not hold;
- promotional content for businesses or events not covered by the listing;
- spam, keyword stuffing, or content designed to manipulate search rankings rather than inform visitors;
- any content that infringes the intellectual property rights of a third party.
8.5 Ongoing compliance
You are responsible for keeping your listing up to date. If your business closes, relocates, or changes category, you must update your listing promptly. Listings that are found to be materially inaccurate or out of date may be suspended pending correction.
Summary: Keep your listing accurate and use only your own photos. Don’t exaggerate certifications or mislead visitors. If anything changes about your business, update your listing.
9. Content and Intellectual Property
9.1 Your content
When you submit a listing, you provide content including (but not limited to) text descriptions, photographs, logos, brand names, and other materials (“Your Content”). You retain all ownership rights in Your Content.
9.2 Your warranties
By submitting Your Content, you warrant that:
- you own all rights to Your Content, or hold a valid licence permitting you to submit it for use on the Platform;
- Your Content does not infringe the copyright, trade mark, or any other intellectual property rights of any third party;
- Your Content is accurate and not misleading; and
- you have obtained all necessary consents where Your Content includes images of identifiable individuals.
9.3 Licence grant to Spiżarnia REGIO
By submitting Your Content to Vina Gallica, you grant Spiżarnia REGIO a non-exclusive, royalty-free, worldwide licence to use, publish, display, reproduce, and promote Your Content for the following purposes:
- displaying your listing on vinagallica.com;
- featuring your listing in marketing materials, newsletters, or editorial content produced by Vina Gallica;
- promoting your business on Vina Gallica’s social media channels (see Section 10).
This licence remains in effect for as long as your listing is active on the Platform. Upon deletion of your account or removal of a specific listing, the licence terminates for that content, except where content has already been incorporated into materials that are not reasonably retrievable (such as previously published social media posts).
9.4 Vina Gallica’s intellectual property
All Platform content not provided by users — including the Vina Gallica name, logo, design, software, editorial content, and the map and directory structure — is owned by or licensed to Spiżarnia REGIO. You may not reproduce, distribute, or create derivative works from any of this content without prior written permission.
9.5 Responsibility for your content
You are solely responsible for the accuracy and legality of Your Content. Spiżarnia REGIO does not verify the accuracy of listing content beyond the initial moderation review described in Section 7.
Summary: You keep ownership of everything you submit. By uploading it, you allow us to display it on the Platform and use it to promote your business. We won’t sell your content or misuse it.
10. Social Media and Marketing
10.1 Promotion on social media
Vina Gallica maintains a presence on social media platforms including YouTube and TikTok. As part of our editorial and marketing activities, we may feature individual listings or businesses in social media posts, videos, or other promotional content.
By submitting a listing and agreeing to these Terms, you consent to your business and listing content being featured in Vina Gallica’s social media and marketing activities. This is part of the promotional exposure the Platform is designed to offer.
10.2 Nature of social media features
Features on social media are at Vina Gallica’s sole editorial discretion. Not all listings will be featured, and featuring cannot be guaranteed as part of any plan. Features are undertaken as editorial content, not as paid promotion.
10.3 Withdrawal of consent
If you wish your business not to be featured on social media going forward, you may notify us at partners@vinagallica.com. We will honour such requests for future content. However, content already published on third-party platforms (e.g. YouTube or TikTok) may not be immediately removable due to the nature of those platforms.
Summary: By listing your business, you agree that we may feature it on our YouTube, TikTok, or other social media channels as part of our editorial activity. This is not a paid service — it is purely at our discretion. If you’d rather we didn’t feature your business, let us know at any time.
11. Account Suspension and Termination
11.1 Termination by you
You may delete your account at any time through the Settings section of your account dashboard. Following account deletion, your personal and business data will be deleted within 30 days, in accordance with our Privacy Policy. No refund will be issued for any remaining Premium period.
11.2 Suspension or termination by Spiżarnia REGIO
Spiżarnia REGIO reserves the right to suspend or terminate your account without prior notice if:
- you have provided false or materially inaccurate information during registration or in a listing;
- you have materially violated these Terms (including the listing standards in Section 8);
- your account is being used for fraudulent, illegal, or abusive activity; or
- we are required to do so by law or a competent authority.
Where the violation appears capable of remedy, we will, where reasonably practicable, give you notice and an opportunity to correct the issue before taking action.
11.3 Effect of non-payment
Non-renewal of the Premium Plan does not constitute grounds for account termination. Your account will remain active, and your listings will revert to the Free Plan in accordance with Section 5.6. Termination by Spiżarnia REGIO is reserved for the situations described in Section 12.2.
11.4 Effect of termination
Upon termination of your account (for any reason):
- all your listings will be removed from the Platform;
- your access to the account dashboard will be revoked;
- any licence granted to Spiżarnia REGIO over your content will terminate, subject to Section 9.3; and
- provisions of these Terms that by their nature survive termination (including Sections 9, 13, 14, and 18) will remain in effect.
Summary: You can close your account anytime from the dashboard. We can suspend or close accounts that violate our rules. Not renewing Premium just puts you on the free plan — it doesn’t close your account.
12. Limitation of Liability
12.1 Scope of the Platform
Vina Gallica provides a listing and mapping platform. It is not a booking engine, a sales platform, a review platform, or a marketing agency. We do not represent or warrant that listing on Vina Gallica will produce any particular commercial result for your business.
12.2 Cap on liability
To the maximum extent permitted by applicable law, Spiżarnia REGIO’s total aggregate liability to you — whether in contract, for breach of statutory duty, or otherwise — arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount you have paid to Spiżarnia REGIO in the 12 months immediately preceding the event giving rise to the claim.
12.3 Exclusion of indirect and consequential losses
Neither party shall be liable to the other for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of revenue, loss of business, loss of anticipated savings, or damage to reputation, whether or not such losses were foreseeable or the party had been advised of their possibility.
12.4 Platform availability
Spiżarnia REGIO shall not be liable for any loss or damage arising from temporary unavailability of the Platform, including where this results from maintenance, software updates, third-party infrastructure failures (including Cloudflare), or events outside our reasonable control.
12.5 Exceptions
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by French law.
Summary: We’re not responsible if your listing doesn’t generate the business results you hoped for. If something goes wrong on our end, our liability is capped at what you’ve paid us in the past year, and we’re never liable for lost profits or indirect losses.
13. Indemnification
You agree to indemnify, defend, and hold harmless Spiżarnia REGIO, its proprietor, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your Content, including any claim that it infringes a third party’s intellectual property rights;
- your breach of any representation, warranty, or obligation under these Terms;
- your use of the Platform in violation of applicable law; or
- any claim by a third party arising from information or images you submitted to Vina Gallica that are inaccurate or misleading.
Summary: If your listing causes a legal problem — for example, because you used someone else’s photo without permission — you’re responsible for handling that, not us.
14. Future Features
14.1 Platform development
Vina Gallica is an actively developed platform. We are working on additional features, including a Cinema section featuring video content about French wine businesses and regions, as well as video partnership programmes for businesses that wish to commission or feature in Vina Gallica video content.
14.2 Updated Terms
When new features with material commercial or legal implications are launched, these Terms will be updated in advance in accordance with Section 16. You will be notified by email before any such changes take effect.
14.3 No current commitment
The mention of future features in these Terms does not constitute a commitment to deliver them by any particular date. Platform features may be introduced, modified, or discontinued at any time.
Summary: We’re building new features, including a video/cinema section. When those launch, we’ll update these Terms and let you know in advance.
15. Changes to These Terms
15.1 Right to update
Spiżarnia REGIO may update these Terms at any time to reflect changes in the Platform, applicable law, or our business practices.
15.2 Notice of material changes
For any material change — meaning a change that meaningfully affects your rights or obligations — we will notify you by email at least 30 days before the updated Terms take effect.
15.3 Acceptance
If you continue to use the Platform after the notice period has elapsed, you will be deemed to have accepted the updated Terms. If you do not accept the updated Terms, you may close your account before the new Terms take effect.
15.4 Minor changes
For minor or non-material changes (such as corrections of typographical errors, clarifications that do not alter the substance of any clause, or updates to contact details), we may update the Terms without the 30-day notice period, but we will always update the “Last updated” date at the top of this document.
Summary: If we make important changes, we’ll email you at least 30 days in advance. If you keep using the Platform after that, it means you agree to the new Terms.
16. Language
16.1 Language of the Terms
These Terms are available in English and in French. In the event of any conflict or ambiguity between the two versions, the French version shall prevail.
The French version is available at vinagallica.com/fr/conditions-generales.
16.2 Language of proceedings
Legal proceedings arising under these Terms shall be conducted in French, before the competent courts of France as identified in Section 17. An English translation of any procedural documents may be requested at the cost of the requesting party.
Summary: These Terms exist in both English and French. In case of any conflict between the two versions, the French version prevails. Any legal proceedings will be brought before French courts and conducted in French.
17. Governing Law and Dispute Resolution
17.1 Governing law
These Terms and any dispute or claim arising out of or in connection with them — including non-contractual disputes — shall be governed by and construed in accordance with the laws of France, in particular the French Civil Code (Code civil) and applicable French commercial statutes (Code de commerce).
17.2 Good-faith resolution
Before initiating any legal proceedings, both parties agree to make a genuine effort to resolve any dispute by exchanging written communications by email (at the contact addresses set out in these Terms) over a period of at least 30 days. This is not a condition precedent to legal proceedings, but a mutual commitment to attempt a reasonable commercial resolution first.
17.3 Jurisdiction
If the dispute cannot be resolved by negotiation, the parties submit to the exclusive jurisdiction of the competent commercial courts of Paris, France (Tribunal de commerce de Paris).
17.4 B2B context
As this is a B2B agreement, the parties acknowledge that no consumer arbitration schemes or consumer dispute resolution platforms (médiation de la consommation) apply to this relationship.
Summary: If there’s a disagreement, we’ll try to sort it out by email first over 30 days. If that fails, the Commercial Court of Paris will handle it under French law.
18. Miscellaneous
18.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spiżarnia REGIO with respect to your use of the Platform, and supersede all prior agreements, representations, or understandings relating to the same subject matter.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from the Terms. The remaining provisions will continue in full force and effect.
18.3 No waiver
Failure by either party to enforce any provision of these Terms at any time does not constitute a waiver of that party’s right to enforce the same provision in the future.
18.4 Assignment
Spiżarnia REGIO may assign its rights and obligations under these Terms to a successor in the event of a business transfer, merger, or acquisition, provided your rights under these Terms are not materially diminished. You may not assign your rights or obligations under these Terms without our prior written consent.
18.5 Force majeure
Neither party will be liable for any delay or failure to perform obligations under these Terms to the extent that such delay or failure results from circumstances beyond their reasonable control, including natural disasters, government action, widespread internet outages, or other events that could not have been reasonably anticipated or avoided.
